fa تحلیل مبانی مذهبی قیامهای 1299 تا 1304 عراق و پیامدهای آن در ایران تخصصي تاریخ اسلام Islamic History پژوهشي Research مقاله حاضر مبانی فقهی مخالفت مراجع با قیمومیت انگلستان بر عراق را مورد بحث قرار میدهد و نسبت این مبانی با حوادث رویداده شده را در حد امکان مورد بررسی قرار میدهد. در این راستا قاعده نفی سبیل، حدیث اعتلاء، بیعت شرط و مبحث احکام ثانویه به عنوان مبانی جنبش مزبور به اختصار بررسی شده اند و بازتاب آن جنبش در تهران مورد بحث واقع شده است. مقاله تلاش کرده است با استفاده از روش توصیفی-تحلیلی بین قرارداد سایکس-پیکو به عنوان زمینه جنبش با موافقت نامه سن رمو به مثابه تصمیم نهائی قدرتهای بزرگ ارتباط برقرار کند و نشان دهد هدف مقاله نشان دادن این است که موضوع انقلاب عراق در دوره بعد از جنگ اول جهانی، صرفاً امری سیاسی نبود؛ بلکه از زمینه های فقهی برخودار بود که همه مستند به سیره حضرت رسول و ائمه در تاریخ صدر اسلام بودند؛ در نتیجه جنبشهای اسلامی بعدی هم بر همان مبانی شکل گرفتند.  This study discusses the juridical basis of high cleric opponents to the British protection upon Iraq after WWI and survey the relation of jurisprudence with happened events as much as it possible. In this regard the Nafy-e-Sabil rule, ‘Etela Hadith, Conditional Bai’a and secondary warrants as the basis of so-called movement discuss in brief and the reflection of the movement in Tehran has been analyzed. Also the reasons of discuses of the movement have been searched according to many unpublished records, journals, Persian and Arabic sources.
